Terms of Service

These terms are an agreement between you and [LEGAL BUSINESS NAME, e.g. How To Scale My Brand LLC] ("we", "us"), which runs WinVault. By paying for a plan or using the site, you agree to them. If you don't agree, don't use the site.

1. What WinVault is

WinVault is a monthly membership with researched e-commerce product ideas. Depending on your plan it also includes AI-generated marketing materials: ad copy, product page copy, offers, video scripts and images ("Ad Kits"). It is an educational research tool. It is not financial, legal or business advice.

2. No guarantee of results

Product scores, sales figures, revenue estimates and trends come from third-party data sources and our own scoring method. They can be incomplete, delayed or wrong. A product that sold well for others may not sell for you. We do not promise that you will make any sales, revenue or profit. Results depend on your store, ads, budget, suppliers, timing and effort. Any example results we show are not typical and are not a prediction of yours.

3. Plans, billing and automatic renewal

• Products: $49.97 per month, 8 products a month released 2 at a time each Monday.
• Launch Kit: $149.99 per month, 20 products a month released 5 at a time each Monday.
• Done For You: $299.99 per month, 40 products a month released 10 at a time each Monday.

Your plan renews automatically every month and your card is charged the plan price on each renewal date until you cancel. Prices are in US dollars and don't include any taxes that apply. Payments are processed by Stripe. We may change prices for future billing periods; we'll email you at least 14 days before a price change takes effect, and you can cancel before then.

4. Cancelling

You can cancel anytime, online, from Manage plan in your account. Cancelling stops the next renewal. You keep access until the end of the month you already paid for. Refunds are covered by our Refund Policy.

5. Your account

Your membership is for one person. Keep your password private. Don't share your login, resell or republish the product research or Ad Kits as a competing service, or scrape the site. We may suspend or close accounts that break these terms, and an account closed for breaking them is not refunded.

6. Using Ad Kits and AI-generated content

Ad Kits are written and made with AI tools and may contain mistakes. You may use them to market your own store. Before you publish anything, you are responsible for:

• Checking every claim against your supplier's documentation and filling in any [bracketed] details.
• Following the advertising rules of Meta, TikTok and other platforms, and laws such as the FTC Act.
• Not making health, medical, weight-loss or income claims you can't support.
• Not presenting AI images as photos from real customers, and not posting fake reviews or testimonials.
• Making sure you have the right to sell the product, including trademarks and product safety rules.

Links to TikTok videos and competitor stores are for research. Those videos and stores belong to their owners, so don't copy or re-upload them.

7. Our content

The site, its design, scoring method and research write-ups belong to us. Your membership gives you a personal, non-transferable licence to use them for your own business while your plan is active.

8. Disclaimers and limit of liability

The service is provided "as is" and "as available", without warranties of any kind, to the extent the law allows. To the extent the law allows, we are not liable for lost profits, ad spend, inventory costs or indirect damages, and our total liability for any claim is limited to the amount you paid us in the 3 months before the claim.

9. Changes

We may update these terms. If a change is significant, we'll email you before it takes effect. Continuing to use the site after that means you accept the new terms.

10. Governing law

These terms are governed by the laws of [STATE whose laws govern the terms, e.g. Florida], United States, without regard to conflict-of-law rules.
